American Express to refund $85M to customers

American Express will refund $85 million to customers to settle regulators' accusations that it charged unlawful late fees and deceived customers to pressure them to pay off old debts or buy extra credit card services, regulators said Monday.
Three?subsidiaries misrepresented the perks consumers would receive if they enrolled in a credit card program, charged certain consumers higher late fees than were legally permissible, misled consumers about debt collection and committed other violations, the U.S. Consumer Financial Protection Bureau said.
Besides the refund to about 250,000 customers, American Express will pay civil penalties totaling $27.5 million to the CFPB, Federal Deposit Insurance Corp, the Federal Reserve and the Office of the Comptroller of the Currency.
"Several American Express companies violated consumer protection laws and those laws were violated at all stages of the game - from the moment a consumer shopped for a card to the moment the consumer got a phone call about long overdue debt," CFPB Director Richard Cordray said.
The consumer bureau was created by the 2010 Dodd-Frank financial law and charged with overseeing credit cards, mortgage loans and other consumer financial products.
Since opening in July 2011, the agency has gone after credit card companies for violating consumer laws. Discover Bank, part of Discover Financial Services, agreed to pay $214 million to resolve charges of deceptive marketing. Capital One Financial Corp was fined $210 million in July on similar charges.
The latest probe identified marketing violations and other problems that occurred from 2003 to the spring of 2012 at American Express Centurion Bank, American Express Bank and American Express Travel Related Services Company.
Those companies are responsible for notifying consumers.
"From the moment we learned of the wrongdoing at American Express, we have been troubled by the range of problems that our examination process uncovered," said Kent Markus, assistant director of enforcement at the CFPB. "The legal violations we discovered span the lifecycle of a consumer's experience with American Express cards."
American Express is conducting an internal probe of the violations and has already counted a "substantial portion" of expenses related to the charges against its earnings, spokeswoman Marina Norville said.
American Express said in February that it was expecting regulators to bring enforcement actions related to late fees charged on certain card accounts.
Consumers are expected to receive payments by March 15, 2013, the CFPB said.

Econ recovery likely _ benefiting election winner
WASHINGTON (AP) ? Eventually, the economic recovery will pick up steam ? whether Barack Obama or Mitt Romney is in the White House.
That's what many economic outlooks project. And the president ? and the party occupying the Oval Office ? will reap some of the benefits.
But first, Obama or Romney, together with Congress, will have to pull back from the widely deplored "fiscal cliff," the politically created budget abyss facing the nation at year's end.
The betting on that ranges from mild optimism to nail-biting anxiety. But most economic analysts agree that if Washington resolves that looming crisis, Americans can expect faster economic growth and lower unemployment.
"Regardless of who is president, if the next president is able to nail down these fiscal issues, then I do think we're off and running," said Mark Zandi, chief economist at Moody's Analytics.
That would be welcome news for a nation that has been struggling through a slow comeback from the deepest recession and fiscal crisis since the Great Depression ? and needs to shore itself up quickly in the event Europe slips back into recession.
Six countries in the eurozone ? Greece, Spain, Italy, Cyprus, Malta and Portugal ? already are in recession. And the continent's struggles were underscored Monday by data showing that unemployment remained at its record high rate of 11.4 percent in the 17 countries that use the euro.
Politically in the U.S., a strong rebound would be great news for a Romney presidency or an Obama legacy. And it would do much to enhance or repair the brand of either of the political parties, whichever holds the White House, before the 2014 congressional elections and the 2016 White House race.
Jared Bernstein, former chief economist for Vice President Joe Biden, said presidents actually have the greatest impact on economies when markets fail.
But, he added: "We will never live in a world where presidents don't take credit of for an improved economy on their watch."
Both Obama and Romney have placed great stock in their economic recovery plans during this year's campaign, Obama with his "balanced approach" of tax increases for the wealthy and spending reductions, Romney with his spending cuts and lower tax rates.
But many economists say the fate of the recovery rests not so much with those specific plans as it does with a bargain ? either at year's end or during the first several months of 2013 ? by the new or the re-elected president and Congress that avoids steep and immediate spending cuts and an immediate across-the-board tax increase.
Congress and Obama agreed that those drastic deficit-cutting measures would take effect in January unless lawmakers and the president worked out and approved other proposals in the meantime. That intense debate will resume in earnest almost immediately after the Nov. 6 election.
" If the cliff is resolved in a relatively benign fashion where there is modest fiscal austerity and serious compromise between the two parties, then the economy can go back to its recovery," said Ethan Harris, co-head of global economic research at Bank of America Merrill Lynch. "If they really do a poor job of handling the fiscal cliff, they may actually kill this potential rebound."
How will that question be resolved?
Republicans have been adamant that no solution should include a tax increase, even on higher income taxpayers. Romney has embraced that stance. But in a recent panel discussion, Romney economic adviser Kevin Hassett pointed out that the countries that have been most successful at reining in their deficits have been the ones that accomplished it with a mix of 85 percent cuts and 15 percent tax increases.
Obama has criticized Romney for proposing a 20 percent cut in marginal tax rates, arguing it would either lead to higher federal deficits or to higher taxes for the middle class. But Hassett indicated that if Romney and Congress were unable to find enough savings by eliminating tax loopholes and breaks to cover the lost revenue, the tax cut would be adjusted so it wouldn't be so steep.
Obama officials say they are optimistic that they can reach a sweet spot of compromise that restrains deficits over time but is not so austere that it damages the recovery. Obama and his aides insist they will not simply buy time or agree to a short extension of all Bush-era tax cuts. Obama has said the election will help resolve the issue.
"I'm hoping that after the smoke clears and the election season's over that that spirit of cooperation comes more to the fore," the president told CBS' "60 Minutes" last week.
But Harris, the Bank of America Merrill Lynch economist, said the election may not prove a decisive factor on a debt compromise. That's because Romney has not specified what government spending or tax loopholes he intends to eliminate, and Obama has not offered details on what entitlement cuts he would undertake.
"The two parties are offering all sugar and no medicine solutions," Harris said. "Neither party comes out of the election with a clear mandate. You only have a mandate if you have specific proposals."
The business sector is anxious ? and weighing in.
Boeing chairman and CEO Jim McNerney told reporters in a conference call that chief executives "wouldn't be uncomfortable" with some tax increases if the overall package included larger spending cuts. He specifically cited a proposal by a commission headed former Republican Sen. Alan Simpson and Democrat Erskine Bowles that would provide $3 in spending cuts for every $1 in additional revenues.
Success is critical.
The nonpartisan Congressional Budget Office has concluded that the drastic cuts and tax increases that Congress and Obama agreed to confront at year's end in order to force action on a more temperate debt-control package would lead to a recession in 2013 and drive up unemployment to 9 percent or more.
If the "cliff" is avoided with a more modest package that doesn't strike so fast, economists see a much rosier scenario. Moody's Analytics projects gross domestic product, the main measure of the economy, to grow at a 4 percent clip or more in 2014, compared to less than 2 percent so far this year, and unemployment to fall to 5.6 percent in 2016.

In order for someone to help themselves improve, they must first of all identify areas that need improvement in their lives, health, relationships, prosperity or whatever.

It will be useful to state these in writing and regularly refer to them so they remain focused.
Another important area to point out is for them to identify how they think they will be able to achieve their goal. So, a written action plan should then be put in place. This is achieved by self-enrichment of their mind, character and attitude. It requires effort, patience, perseverance and commitment and this change does not come easily.

Self-enrichment of mind, character and attitude are done by continuously exercising your mind with positive thinking.
This is when one repeatedly tells themselves that they are just as good as anyone, can get better and can achieve anything in life. While this sounds easy, is the most difficult and yet a very important part of self-improvement. This is so because of the way we have been raised, who we are, our values and beliefs.
It is also the constant conflict with the subconscious mind that needs to be kept in check if one is going to achieve their goal of self-improvement.
Another important area is goal setting. It is necessary that you start with short term, simple, easily achievable goals, possibly in a day, before you set big goals that will take you a while to achieve. Setting huge goals that take a while to see results usually bring in procrastination. To stay motivated, it is necessary that you set simple goals first.
Setting a routine and self-discipline are the other skills required in achieving self-improvement. These can not be emphasised enough as they have a huge impact on your success. Results can only be seen when you stick to them and they help you stay motivated as well.
Identifying self-defeating behaviors like doubting your own ability to achieve, the ?I can not do this or this is for the rich? and addressing them permanently is also important. Rewarding yourself-is also important when you have achieved even the simplest of your set goals. It will help you stay motivated.
It is worth noting also that self-improvement is not an overnight thing but a process as already stated so stick with it, be faithful to yourself-and remember, it is alright to slide back a bit. As long as you realize that you are falling behind and pick yourself-up again, you will be able to achieve your goal of self-improvement.

Westminster Launch New Track At Paddington Rec - London Athletics
A new 400 metre athletic track has opened at Paddington Recreation Ground thanks to a partnership with the City of Westminster, London Marathon Trust and the Greater London Authority.The track is complete with new throw and jump areas. The track was opened by GB athletes Larry Achike and Laura Turner who delivered athletics coaching at the launch.
Westminster Run! Activator Ellie Wood said; 'The launch of the new track coincides with the launch of Serpentine Junior Athletics Club which will provide our young people with a level of athletics coaching never seen in the borough before. Provision will be for long and short distance running as well as field events and Sportshall competitions. The club will be used to train and select teams for the London Youth Games.'
The 5000m and 10,000m gold medallist Mo Farah has backed the ?240,00 revamp of Paddington Recreation Ground?s track, which has been closed for the development over the summer.Farah said: ?Central London getting a new running track is great news for athletes of the future.
?The London Olympic Games will inspire a whole new generation of potential sports men and women and it is good to see Westminster Council leading the way in bringing important new facilities to the heart of the capital.?
The track, which opened on September 26 will offer an international standard running track and top quality facilities for field events.
It will be available for free casual use and coaching sessions, as well as providing a spot for schools to train and run sports days.
The Marathon Trust provided ?130,000 for the project, The London Mayor?s Legacy Fund provided ?44,000 and the remainder was met by Westminster Council.
Cllr Steve Summers, deputy cabinet member for Olympics, sport and leisure, said: ?It is great to see that one of the stars of the Olympic Games is backing this project.
?We hope that hundreds of people will be inspired to take up track and field sports and maybe even go on to represent the UK in Olympics around the world.
